Isn't the Surge illegal to carry in Germany?

DISCLAIMER: The following is in no way to be understand as a juristical appraisal. This is for all intents only my personal opinion!

Simple answer: It's complicated. You would be on the safe side with only 2HO blades. (Rebar, SuperTool, etc). A Surge should not be a problem, if you are not using it to conduct a felony or carrying it to a demonstration. (Other laws apply then)

Longer answer:
It is not illegal to own the Surge/Wave/Charge.
Carrying it can be problematic because of german weapon laws:
An one-hand locking folding knife is only allowed to be carried in public spaces with the intention to use it for socially accepted purposes.
(§42a WaffG)
(Please don't ask me, what the smurf the politicians meant with that word construct! And I hope I did not get totally lost in the translation.*)

The problem starts with the question:
Is a LM Surge a knife or a tool?
Be advised: All my further explenations are not backed by any precise laws or court findings!
Saying it is a knife, it sure is one-hand locking (Linerlock). You would be then only allowed to carry it for work or other accepted purposes. This includes the way to and from those venues.

In short: It is not generally forbidden, but it is not strictly allowed, either. It is not even clear, if a plier-based multitool is affected by the weapon law. And there is no clear juristical definition.

* This law was written as a tool for the police. The aim was to enable the police to confiscate knives not strictly forbidden (like balisongs, or automatic knives) in inadequate situations, e.g. in discotheques, in the hand of juvenile Gangstas, etc. while still allowing other uses.
In the end, it just created a massive blob of insecurity, whether a knife is allowed or not.

@bmot

Really short answer ... If you put a padlock on your LM sheath, it's legal to carry a Surge. (... gilt nicht für den Transport in einem verschlossenen Behältnis - Law doesn't apply if transported in a locked "container" )

@JAfromMn: All the best for your move!

@bmot, enki_ck.: Yes, the german law differates between 'führen' - to have on your person and 'transportieren' - to move inside a locked case.
And every policeman seems to see the law different. There are literally cases where it is argued, if 'inside a car' constitutes 'inside a locked case'

No point to carry it if you can not use it, what if they caught you while you using it?

Ok, obviously I did not manage to translate the law accordingly

If you plan on using it, you can carry it. But you are not allowed to carry it 'just in case'.

Fat man just saved my butt again.

I shut off my truck on a sort of remote jobsite and it wouldn't start again.

I tightened the battery posts and I was back on the road.

it wasn't my normal work truck so I didn't have my tool box.

I'd still be there if not for the Fat Man.

Well I went home early yesterday from work because I didn't feel well so my favorite explosive team didn't see much use .

today

I'm finishing what I started yesterday morning. Cleaning, inspecting and protecting a couple of new homes at work getting them ready to show to the public.

not a whole lot for the fat man to do. He did tighten a lose towl rack but for the Smurf of it I'm using him to cut the plastic I lay over carpet floors to protect them.

I usually use a sharp utility knife with a hook blade.

fat mans plane edge blade is as sharp as I can make it . His blade melted through the 6 mil plastic like butter.

i was a little impressed with the nice straight smooth looking cuts it made. Its beyond razor sharp. No snagging or ripping through just a nice clean cut.

Speaking as someone that lives in a house made of stone, specifically Norfolk flint, you don't really want to live in a house made of stone. The WiFi doesn't go through walls well and mobile reception is rubbish.

what I'm wondering how would the new Surge stack against the Fat Man in your use. considering the tool loadout is quite similar but the overall design isn't

the surge.

I haven't owned one but I need too

the new surge with the st300 plier head should stand up to my work.

I haven't used a wave style tool on the job yet

I've been hooked on the normal butterfly opening tool.

I have owned a few waves a charge tti and I still got a Bo charge alx I'm going to edc as my off work tool when I wrap this review up.

maybe I should do a similar review using a surge at work and the alx at home.

weekend update

the fat man had it easy last week. We got some homes ready for sale. The fat man opened packages, cut tape, plastic sheeting, straps, holding the new appliances closed,

little boy has been helping me work on some knives and tools I'm restoring. Not alot of work for him but he's trying to help. Opening packages and snacks :)

The fat man proved himself a excellent paint can opener at work today. A easy task.

there's lots of snow falling today

I'm sure we will be plowing tomorrow.

I was just abusing the fat man .

I used him to remove rusty coder pins holding a lock nut .

I had to give it my all and pry with the pliers to get them to come out.

I'm starting to be impressed with how strong the cc pliers are.
