How do the authority knows that the contents inside those blank hard disk/cd/usb sticks is not original? This may drive away those who actually are law obeying, thinking that they are charged for something they didn't do, may as well just start downloading to make its worth.

By downloading, do you mean movies and music? Or just about any kind of 'download' is illegal? That's a really really board spectrum, and sometimes I do see 'free' music for people to download, and composer did claim user can use it for free so as long they give the composer credits--would that be illegal in Canada by definition as well?
