Use of Swiss cross or Vic logos on customs for sale
on: November 26, 2014, 06:09:50 PM
Curious about the use of possibly trademarked logos on customs for sale.  To me almost like making a leather handbag and slapping a gucci logo on it.  Just wondering about the legality of it.

I see what you are saying, but the only difference in the customs SAK's and "slapping a Gucci logo on a bag" is that with the custom SAK's they are not trying to fool anyone into believing they are genuine, original SAK's. You know you are getting a custom. With the hand bag thing they are counterfeit and copies of originals made with the intent to fool people into buying them thinking they are purchasing a original.

Now their could still be a possible issue with using the shield in a custom, but I have no idea about that.

Swiss federal shield is protected under law. Even Vic and wenger had problems with its use and the swiss goverment almost banned them from using it a few times, last time a few years back. It's heavily regulated.

I see.  So using it would be a bit of a no no.  Interesting

What about using just a plain cross like on the old Pioneers?

Even though it's not counterfeit, selling the knife with the logo may not be kosher. It's all about brand recognition.  If the custom were for myself and not for sale, I think perhaps ok.  Once for sale, it's another matter.  I could be wrong.  If I owned Vic and sold millions of knives I may not care less.

Interesting topic.  Would be fun to hear the correct answer to this if there was one.

Maybe the modders who are building purely for commercial reasons should have their own logo

I fully agree.  Or perhaps no logo.  I'd only be that proud if I actually made the tools housed inside of the scales.

So by this logic, everyone who modifies a car with a body kit or spoiler or different engine should remove the chev, ford, toyota, etc badging?..

I would think there is more problem using (for example) all the internals of a Victorinox pioneer with custom scales and then putting your own branding / logo on the resulting knife.

Nope.  By this logic I would not make scales and apply a logo to them.  If I put spoilers and a body kit, I believe the logo is already on the car.  Much like using the stock scales, logo is there.  No option of removing it.

Just curious as to the legality of it is all.

And I fully agree with the second part.  I avoid any branding or logos for just this very reason.

Some of it is a grey area.  I would not use the swiss federal cross, or any of the current registered trademarks of Victorinox which are the cross and shield.  Using an old cross is really a + sign, thats not patentable and I see no issue using it.  It could be why they stopped using it on alox.

The Swiss are so positive; you only need to look at their flag!
