M0rkoni - Trade Issue
on: May 26, 2014, 09:36:22 AM
This has been the most frustrating and unsatisfying experience I have for online shopping, and in essence, this is what happened so far:

Seller advertised no fees and free WORLDWIDE shipping with tracking.

The seller refuses to ship worldwide with tracking as it's to costly for him and now insists on an European or US address AFTER I sent him the money resulting in me having to pay EXTRA (approx 10€) for shipping from my mail forwarder.

I will be stuck with 47€ fees I have to pay alone, as he's insisting on getting the full amount without fees. (20€ at my local bank and 27€ to the proxy bank which forwarded the money to him, 0€ fee at his local bank.)

I have paid 80€ in total so far for a SAK that was advertised as 75usd (he demanded Euro and changed the 75usd to 60€).  It is not my fault the proxy bank take a fee of 27€.

Despite all the problems, he insists I pay him for a second deal 135€ we were discussing, only then he would offer to absorb 27€ proxy bank fee for the 1st deal.

In case I misrepresent anything, I will give more detail account for what happened in Feedback section later, after this has settled.

Marko,

A) I understand it is not neither your fault or mine the proxy bank took 27€ fee, I am willing to shoulder half of that fee(13.5€) to complete this sale of cybertool.

Including this 13.5€, I would have already paid 93.5€(approx 127.39USD) for an advertised 75usd item(I still have to pay EXTRA to ship it to Hong Kong).

I know you don't care how much I paid or lost, and you just want your money on both first and second deal.  But given how complex or frustrating this first deal is, I will NOT do the second deal and this is the best I can offer.

B) If you think I have done you great injustice or I 'owe' you anything, please just keep the 33€ in your account for FREE.  I will just forfeit and forget I ever have spent 80€ for nothing.  You will NOT need to send me anything, and after a 33€ FREE money you have received, I seriously doubt you could still claim I owe you anything.

Please keep all the responses to this thread, and if you choose to remain silent, I can only assume you are choosing option B.  In which case, I have paid 80€ for nothing and get to live with a clear conscience. Meanwhile, you have already gotten 33€ free money, and have nothing to lose.

"This has been the most frustrating and unsatisfying experience I have for online shopping"... Yes, there is two of us.

Me to remain silent!? You are the one who didn't communicate with me for the last two days. And I have done everything to push both deals to the right track ... You wrote here only what suits you and I don't want to repeat my self again here because I do have all of ours communication in PMs.

So you know what...I will say just a few things here and don't want to participate in this any more.

First thing, I do not want to convince you any more and to discuss with you any more after I provide you with some official documents from my Bank about transfer fees and I will continue to be a perfect gentleman because I don't want to exposed anybody dirty laundry here in public.

Second thing, after five-six days of ours conversations and after all your conditions via PM's I don't trust you any more and I don't want to continue with any deals with you any more.
What's going on!? Now you want to buy something from me, now you don't want...what a hell!? We have a deal for three knives. Like I said, I don't thrust you any more.

Third thing, I don't want to keep other people's money, money that does not belong to me so would you be so kind to write me your PayPal address to be able to give you back yours 33€...

Thanks.

I have nothing else to say here and don't want to say anything else about this whole situation and don't want to drag my name in public only to justify myself.

Unfortunately, I need to close this thread due to unforeseen circumstances that are not up to me. This is one big lesson for me.
Mods, please update the thread title to reflect this.

Thanks.

P.S.
Please, mods don't close it before I officially announce here that I have give him back his 33€. Just to everything be in public as he wants.
Thanks.

condcup,

I do agree with your statement, same goes to sending money via 'gift' option on paypal to a seller(ebay supposedly have protection for buyer, if money is sent via "good or service").  I think the best practice is to clarify it on the sale thread, before any money is exchanged.

Seller did ask to send both first and second deal payment as 'gift or financial help'.  But to my best judgement and to his credit, I don't think he is here to cheat people's money, and whether a buyer want to take the risk to send the money as 'gift' and 'help' a fellow buyer is solely his own decision or what mutually agreed.

Marko,

I don't want to sound like I am the person to have the last say here, and after what's done and said, I don't think you are a 'bad' seller.  I know you don't really care too much about what I paid or whether I am at lost, and you just want your money for both the first and second deal.

Regarding sale, MTO leave the freedom for seller to decide whom to sell to, regardless of who wants to buy first.  Personally, I think the same would go for a buyer's payment--if arguments have raised and unsettled for the first sale, why should a buyer have to continue with the second deal?

About the 33 euro that I have sent to you, I sense that you still hold grievance towards me, so please just keep the 33 Euro for free, and don't worry about it.  If you really don't want the money, feel free to donate it to MTO.

Whether I am 'trustworthy' or not, I am not going to argue that, it will be just my words against yours.  So I will print out all the complete personal message and put it here for the record.  So any MTO who is doubtful can see for themselves.

Again, I don't think you are a bad seller, I just don't agree with how you want to push to sale despite all this is happening.

Because you continue to write here all kind of stuff about me & my business which are partially true (I just don't want to say any stronger word) and taken out of the concept and you're putting words in my mouth I feel need to say something more, even though I said I would not.

On the contrary, yes, I do care what you paid or whether you are at lost and because I do care I offered you some FREE gifts in total value of 35-40€ to send you beside yours original order as a sign of my good will and you have read this in PM a couple a days ago but that was not good enough for you. And I'll do this for everybody not just for you.

And yes I do care because I give you 10€ discount on the second deal but that was not good enough for you either.

And yes I do care because I offer to pay additional shipping from your European address to yours address in Hong Kong.
By the way, I didn't "demand" European address and EURO as a currency like you said earlier I just ask nicely about these two things and I said that I don't want to cause you any problems if you don't have any of these two things(European address or EURO currency). And I was willing to send you the goods directly to your address in Hong Kong if you don't have some European shipping address. And all this was asked before you pay me. And you do have PM about this. And this was also not good for you.

And yes I do care because I tried to find a PayPal account and I find one which is from my friend just to accommodate him to be able to pay me via PayPal the second transaction and not via Bank transfer again. And he know about this and I accept his wish that this PayPal transaction not go as a "gift" option. Because that is perfectly fine with me but this is not good enough for him also. Do you see any pattern so far?!

I complied with all his wishes and much more...but he simply doesn't want to proceed with the second transaction any more although we had a deal. For a God sake, what more do you want from me!?

"I want to push the sale"!?
And yes, you are not "trustworthy" in my eyes any more because you don't want to go with the second deal and we have an arrangement...and for me a deal is a deal and it is solid as a rock. What kind of man somebody need to be to not honor the deal. It's like we shake hands and look into each others eyes and agree on something and now you don't want to honor that. What the f...!?!? I deeply apologize for the expression... I'm just really pissed off now about whole this thing.

Here is my last PM send to him on May 24, 2014, 11:19:49 AM:

"Hi Chi,

I don't want to repeat my self but I will tell you one more time and just to remind you:
It's not my fault because you paid what you paid and I have not receive that amount. In my thread I said I will pay money transfer fees but in this case I don't have any fees to pay at my end. I already said that and give you some official document from my Bank to prove my claims.

Either of yours offers are not fair, you know.
Only fair in this whole situation will be if we continue with all three knives because we have a deal for all three and a deal is deal. And I just want to honor that.

I have been fair with you from the start:

1) I have give you some 10€ discount in the start for one of those two knives from second transaction (first sign of my good will),

2) I offer to pay shipping from Europe address to your address in Hong Kong (second sign of my good will),

3) I want to give you some valuable gift of 35-40€ values (third sign of my good will)...

4) And by the way that CyberTool was pretty cheap, only 75$ with shipping and everything else. It goes way over 100$ and without shipping cost off course.

I think I have been more than fair with you.

But here you go one final BIG sign of my good will and that's it.

You don't need to pay anything more for CyberTool deal. I'm willing to forget additional 27€ for CyberTool. So now I only get 33€ for that CyberTool instead of 60€ and I need to pay shipping with full tracking of that amount, also. So I have practically nothing of whole deal for CyberTool and practically I will give it for FREE but I'm willing to do that. So this is pretty pretty generous of me.

I will forget those additional 27€ only and only if we continue with second transaction of 135€ for which we have a deal anyway and a deal is a deal like I already said. You need to fulfill your words and to honor the second transaction...only that is fair. And I want to receive whole 135€ via PayPal. Anyway you already said: "I could bare the full 5% fee which is usually paid by the seller".

But know I don't want to pay 10€ shipping from European address to you and don't want to give you any gift's. I'm sorry but now I can't afford all this stuff. You understand my position.

I don't want to negotiate with you anymore, what is enough is enough. I have done everything to push this whole situation on the right track and now I've done everything that you not be damaged in any way. A lot of time has passed and I just want to end this whole thing, to send you the knives and to close the deal.

Marko"

All of the written you already have in my PMs. But now you can freely print out all the complete personal messages and put it here for the record if you have nothing else to do. I think this is ridiculous from you but do what ever you want to do. This is a free country and a great forum.

Regarding 33€
I don't want your money and I will nicely ask you again to provide me your PayPal to be able to refund you 33€... This is not my money and I don't want it. It's yours and when you receive it if you want to donate to MTO just do that and that is perfectly fine with me. I have my own money which I want to donate, like I always do anyway. It's yours and do with it whatever you want when you get it.

Ladies and gentlemen, gals and guys I'm really really sorry because you need to read all this rubbish but I hope that you will be able to understand my situation and my position. This is the longest message that I ever wrote, sorry about that also. And I'm sorry if I was being sarcastic but I'm a little bit angry right now. I just don't want to waste anybody time anymore.

Thanks and I apologize once again to all.

Just to keep the record straight, here is the printout of the messages between me and the seller:

https://www.dropbox.com/s/r4wjzx7a7xfgqbr/Personal%20Messages%20regarding%20cybertool%20sale.pdf

If anyone is reading, please kindly go read these messages, along with my original post, to see whether I am lying or putting words in seller's mouth  ::)

The seller refuses to ship worldwide with tracking as it's to costly for him and now insists on an European or US address AFTER I sent him the money resulting in me having to pay EXTRA (approx 10€) for shipping from my mail forwarder.

Please read message time:
May 21, 2014, 08:56:41 AM Seller informing me the postage is too expensive
May 21, 2014, 12:28:46 PM  Too late, I have already sent the money

*****************************************************************

I will be stuck with 47€ fees I have to pay alone, as he's insisting on getting the full amount without fees. (20€ at my local bank and 27€ to the proxy bank which forwarded the money to him, 0€ fee at his local bank.)

Please read message time:
May 23, 2014, 12:24:30 PM  Info of proxy bank fee, which both of us didn't expect and is no one's fault.
May 23, 2014, 1:46:15 PM   Seller pays 0 internal bank fee, and his "suggestion" of getting the full amount without fees

*****************************************************************

I have paid 80€ in total so far for a SAK that was advertised as 75usd (he demanded Euro and changed the 75usd to 60€).  It is not my fault the proxy bank take a fee of 27€.

Please read message time:
May 23, 2014, 12:24:30 PM   My message, please read option A)

(Edit: While everything in that sentence holds true, in term of wording, yes, it is my fault to say he 'demanded', he merely suggested it and I agreed, and I apologized and do stand corrected)

*****************************************************************

Despite all the problems, he insists I pay him for a second deal 135€ we were discussing, only then he would offer to absorb 27€ proxy bank fee for the 1st deal.

Please read PM time:
May 23, 2014, 03:25:48 PM   Seller first mentioning of will include 'free gift' in 2nd deal
May 24, 2014, 07:05:28 AM  My three options to seller, declining the 2nd deal, and towards the end of message, my answer to his 'opportunity cost'
May 24, 2014, 11:19:49 AM Seller attach the "35-40€" to the 'free gift', and implies that I am 'ungrateful'?

And yes I do care because I give you 10€ discount on the second deal but that was not good enough for you either.

Please read PM time:
May 24, 2014, 07:05:28 AM  My message to seller
"As for the second deal, I am sorry but I have to politely declined.  I understand you are kind enough to give me a discount and I do appreciate it, but that is something that we both agree upon, and I sincerely don't think I am coercing you into giving me a discount."

And yes I do care because I offer to pay additional shipping from your European address to yours address in Hong Kong.

May 23, 2014, 12:24:30 PM  My message to seller, please read
option B) "I would have paid 60+20+27+10 in total 117 Euro for this item"
towards the end, "it could be done with paypal payment(as good and service paid, not gift; I could bare the full 5% fee which is usually paid by the seller)"

I complied with all his wishes and much more...but he simply doesn't want to proceed with the second transaction any more although we had a deal. For a God sake, what more do you want from me!?

Nothing, and please keep the 33 Euro for free, it is my gift for you and I will NOT think any less of you.  I repeat you are not a bad seller, but I just can't agree with your sale technique.

"I want to push the sale"!?
And yes, you are not "trustworthy" in my eyes any more because you don't want to go with the second deal and we have an arrangement...and for me a deal is a deal and it is solid as a rock. Despite we are still not clear on how we should proceed with the 1st deal, seller 'suggest' to continue with the second deal.  If this is not 'pushing', I don't know what is:

Please read PM message time:
May 22, 2014, 08:00:17 PM  Seller message to me:
"Now I'm stuck with those other two knives and don't have a buyers for them because we have a deal from yesterday"
