That is dishonest and taking advantage of a store policy.   It actually meets the definition of fraud because the person doing it is setting out with the these intentions.  Your initial case wasn't fraud because you did not buy the Wingmans with the intent to get more expensive multi-tools (waves).  The Store Manager just did what he could to make the situation right.  But doing it again or encouraging others is just plain wrong.

I refrained from saying anything to you when you first posted what occured, but encouraging others to defraud a company should not be tolerated.

Technically speaking I do not believe it would meet the legal definition of fraud when, even with the full intent of receiving the more expensive tools, all actions taken by the purchaser are in full compliance with a written or implied company's policy (that is, they were able to order the tools they knew the company did not have in stock because the company gave them the opportunity to order and expect them to be available to pick up)

That being said, it can be construed as immoral...

If HD is offering the tool for sale and then cannot deliver at the agreed time, they are obligated to either refund the purchase or offer a comparable item. In the interest of maintaining customer goodwill, they are obviously choosing to substitute a more valuable item rather than nullify the sale. Retail store obviously mark up their merchandise quite a bit to make their profit, and will alter prices when it suits them (clearing old items, loss leaders, etc). I expect there are some stores where the manager would either insist on free home delivery when the item is found, or simply refund the purchase. They would not offer the substitution if the differential between cost and price was too painful.
TL:DR - I would not call this fraud. It is not going to last long anyway, as the new tools will hit the shelves soon. You can debate the morality of it, but that is a very subjective matter.

Gentlemen, let's back it down a little bit here.  I don't think anyone is committing any crimes here one way or another- libel, fraud, theft or otherwise.

This is an internet forum for people to discuss their thoughts and ideas in a non threatening matter.  If you disagree with something, that's fine- have your say but let's try and not get into any legal action here.  The folks at Home Depot are doing something by choice- they don't have to give anything away.  On the other hand, maybe convincing others to try and take advantage of it isn't the most honest thing to do but what we are talking about here is a difference of opinion not any kind of legal bullsh*t and I don't think there's any criminal intent here.

So I suggest we all calm down before this thread finds itself locked.

I hit a HD this morning and same wave crater and kick on the shelf.  Grant did you check a store or just the website? All of my HD's carry the same here in Calgary. I'm not going to bother pre ordering as I'm not in a huge hurry. Anyone know if HD is expecting sidekicks?

I read this thread yesterday (Oct 14th) and called my local HD.  The Service Desk didn't have a clue even providing them with the SKU.  They transferred me to the Tool area and the salesperson looked up the SKU and found it.  She said it was a promotional thing for the holidays.  She told she would look in the back for it and give me a call back if she found any.  I figured I wouldn't hear back from her.  An hour later she called me back and said she put it at the Service Desk with my name on it.  Sure enough I went to the store a couple hours later and there it was!  So now I am also an owner of a Leatherman Wingman!!  Nice tool, especially for the money.  I called early, around 8:20AM, so I think that might have been why the girl in Tools took the time to look.  Before the store got too busy.  If you aren't having any luck at your local HD try calling 15 or 20 minutes after they open when the store is slow.  Great thread and thanks for the heads up.   :tu:    :salute:

I went to my HD today and the guy was very helpful and in the end we discovered that it is being put out on wed. for a holiday promotion.  Guess I am going back on wed.  :D

Mine is telling me the same thing- expect it to be in with the holiday promos, but they also pointed out that due to the pricing they think it is going to be a normal inventory item.

I've worked in retail- you're at the liberty of the warehouse. Assuming they actually put it on the truck like they said. I can remember getting pallet with laptops three feet deep that were supposed to go to different store when I was selling consumer electronics. I can also remember finding laptops UNDER cases of paper. They were very thin....

I stopped in to my local HD today and bought a Wingman. I chatted with a couple of the employees there, and they said the holiday gift display had been put up on Monday. Apparently the stores have been told to have these displays up by November 1, although they can obviously do it sooner if they want.

They hadn't heard anything about the rumored Super Tool 300 / Monarch 400 pack, but it is not unusual for some items to show up later into the holiday sales season. No sign of the Kick being cleared out yet, although I expect that won't happen until the Wingman gets moved back over to the normal spot on the shelves for multitools.

I stopped at the Gander Mountain store today to see if they still had any new gadgets in stock.  There along side the Leatherman tools were spots marked for the Wingman and Sidekick.  No stock yet, but they must be coming soon. 

Menards still have the Kick and Fuse on clearance, but the Blast was back to normal pricing.  They had added camo Fuse to the display at full price.

My Home Depot had several of them for sale today for $24.99.  So they have been emancipated.  As I noted by way of a separate review though, the scissors on mine would not stay locked, and I can't recommend the Wingman for this reason, but it will be seen whether this is a widespread issue or just a prob with my multitool.

Sazabi is right.  They are in the Christmas display area at the front of the store.  The thing is, some Home Depot's may not have their Christmas display area setup yet.  I was passing by a HD yesterday and stopped in to pick one up.  No Christmas area setup yet and no one can find them.  I stopped by my local HD and they had the Christmas area up and mixed in with other Specials was a small Leatherman display with only the Wingman.  It's a great price.

Yep I visited a couple Home Depot stores just before we left LA. I could not see any Wingman at all in their LM section but I did notice one solitary Wingman hanging on a Wave hook on my last day in the states(last Saturday):o :o. There was a staff member near by & asked him 'what's the go mate with the Wingman' he typed the stock number into his hand held electronic thingo & he said there are more in section 24 & sure enough at the front of the store there was a floor stand with Wingman in it. 
So guys have a look around for separate displays away from their normal LM MT section  :think: :think:

The HD's near me are showing 43 Wingman's in stock. I went to one in Ancaster but they are not on the floor yet. I had someone there look it up and she said it looks like they are still sitting in shipping but said she would get the shipping guy to look out for them and once he's found them they will give me a call. They're going for $24.99 at HD Canada but it doesn't look like they have the Sidekick in stock.

The lady I talked to said they were probably being held until Nov. 1 so I guess that's when the HD's in Canada setup their Christmas displays. The HD.ca website won't let you order online. It says for instore pickup only  :cry:

Are they going to be selling the Sidekick at the HD's in the US.
